All rights reserved. These Terms set forth the terms and conditions under which you may use our website and any services / products / content as offered by us on this website, or in any forum. This website offers visitors access to premium health, wellness, fitness, recovery, nutrition, mental / general physical training content, and military and sport related content. By accessing or using the website of our service (or by using any platform or content provider in which we use to share content / information), you approve that you have read, understood, and agree to be bound by these Terms and those set forth below.

The material in which we sell, provide, share, or otherwise provide in any internet or non-internet forum may not be reproduced or disseminated in any form, stored in any retrieval system, or transmitted in any form by any means—electronic, mechanical, photocopy, recording, or otherwise—without prior written permission of Blue Green Training LLC. This material may only be viewed by the individual who purchased (or was provided the content from a member of the Blue Green Training LLC team) access to that specific product. Failure to follow this policy, or any of the information contained within this legal policy will result in the user being banned from the Blue Green Training LLC website, as well as that individual having their access revoked for the material that had been purchased or acquired. Appropriate legal action will be taken by the Blue Green Training LLC legal department in any event of a breach of the material listed in this legal policy.

Website use and account requirements

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Key commercial Terms offered to customers

When acquiring an item and/or service (includes purchasing for the monetary amount/cost indicated and/or requesting and receiving an item and/or service for no monetary amount/cost), you agree that: (i) you are responsible for reading the full item and/or service listing before making a commitment to acquire said item and/or service (includes purchasing for the monetary amount/cost indicated and/or requesting and receiving an item and/or service for no monetary amount/cost): (ii) you enter into a legally binding contract to acquire said item and/or service (includes purchasing for the monetary amount/cost indicated and/or requesting and receiving an item and/or service for no monetary amount/cost) and you complete the check-out process (may or may not include payment). The prices we charge for using our services / products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on the agreed upon basis to your payment method.

*Please note the terms/phrase “item and/or service” refers to any physical and digital/non-physical product listed, advertised and/or described/promoted on the Blue Green Training LLC website or any related internet/non-internet forum (to include social media).

Return and refund policy

We do not offer any returns or issue any refunds for any of our digital products or services. Non-digital products may be returned if unused, tags remain on the product (where applicable), and product is in its original condition. It is the responsibility of you as the customer for covering any and all return shipping and handling costs. If you have an issue or concern with a product or service purchased / acquired / accessed from us, please contact us directly and we will make every effort to work with you to resolve your concern but cannot guarantee any accommodation of your request. 

Retention of right to change offering

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason. This includes a termination, change, or otherwise altering of access to guides that have been purchased / acquired (when provided to you by a member of the Blue Green Training LLC team) without cost.

Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Blue Green Training LLC. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

Right to suspend or cancel user account

We may permanently or temporarily terminate or suspend your access to our website / services without notice and liability for any reason, including (if in our sole determination) you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time – for digital content, this will not result in a refund. Notwithstanding anything to the contrary in the foregoing, with respect to automatically renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

Indemnification

You agree to indemnify and hold Blue Green Training LLC and its owners, partners, contractors, employees and all associated persons harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website. This includes any personal injury or loss due to the use of any product or service sold on our website (including but not limited to any physical training, nutrition, mental education or recovery guides/plans).

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Blue Green Training LLC and its owners, partners, contractors, employees and all associated persons, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Blue Green Training LLC and its owners, partners, contractors, employees and all associated persons assumes no liability or responsibility for any:

1. errors, mistakes, or inaccuracies of content;
2. personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our products or services
3. any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

By accessing the website and/or creating an account you agree and consent to the following:

You are voluntarily purchasing (or acquiring / gaining access to without cost) and participating in the program(s) / content owned and distributed by Blue Green Training LLC. You recognize that the program(s) / content you purchase / acquire without cost may require physical exertion that may be strenuous at times and may cause physical injury and you are fully aware of the risks and hazards involved.  You understand that it is your responsibility to consult with a physician prior to and regarding your participation in the above-mentioned program(s). You represent and warrant that you have no medical condition that would prevent your participation in the program.  You agree to assume full responsibility for any risks, injuries or damage know or unknown which you might incur as a result of participating in the program. Such injuries may include, but are not limited to, heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, injuries to back, injuries to foot, or any other illness or soreness, including death. You knowingly, voluntarily and expressly waive any claim you may have against Blue Green Training LLC and its owners, employees and all associated persons for injury or damages that you may sustain as a result of participating in the program(s).  You, your heirs or representatives forever release waive, discharge and covenant not to sue Blue Green Training LLC and its owners, employees and all associated persons for any injury or death caused by their negligence or other acts.  You have read the above statements and clauses and release of liability and fully understand it contents. You voluntarily agree to the terms and conditions stated above.

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

You agree to receive from time-to-time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please notify us at any time.

What type of information do we collect?

We receive, collect and store any information you enter on our website or provide us in any other way. When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.

We collect such Non-personal and Personal Information for the following purposes:

• To provide and operate the Service. As one example, when you purchase / acquire / gain access to a guide from Blue Green Training LLC, you will be asked to create an account. Account creation allows you to access that guide.
• To provide our Users with ongoing customer assistance and technical support.
• To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages.
• To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services.

How do we store, use, share and disclose our site visitors' personal information?

Our company is hosted on the robust Shopify platform. Shopify provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Shopify’s data storage, databases and the general Shopify.com applications. They store your data on secure servers behind a firewall. 

All direct payment gateways offered by Shopify and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. How do we communicate with our site visitors?

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you.
